RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

TLO Saluda River Farms, LLC
(Owner of Property, “Releasees”)

I wish to use the hot tub at The Farm House at Saluda River Farms, located at 73 Quinlan Drive, Greenville, SC 29617, during my stay at your vacation home.

1. General Acknowledgment of Risk

  • No lifeguard is on duty at any time.
  • The renter is responsible for safe operation of the hot tub.
  • The renter is responsible for all persons using the hot tub.

2. Assumption of Risk

My use of the hot tub involves risks including, but not limited to:

  1. Injury due to malfunction of equipment
  2. Tripping or falling in the hot tub area
  3. Unsupervised use
  4. Any activity in or around the hot tub

This list is not exhaustive.

3. Waiver and Release of Liability

  • Waiver of Claims
    I waive all present and future claims against the Releasees.
  • Release of Liability
    I release the Releasees from all liability for loss, damage, injury, or expenses, including those caused by negligence.
  • Indemnification
    I agree to indemnify and hold harmless the Releasees from any third-party claims, including personal injury or property damage.

4. Age and Responsibility

  • I confirm I am 18 years or older
  • I will follow all property rules

5. Binding Agreement

This agreement is binding on me, my heirs, next of kin, executors, administrators, and assigns.

6. Acknowledgment

I confirm I have read and understood this document and voluntarily agree to all terms.
