Kayak Waiver and Release of Liability Form

PLEASE READ CAREFULLY. BY SIGNING THIS DOCUMENT
YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

Thomas and Allison LoPresti and TLO Saluda River Farms, LLC
(Owner of Property, “Releasees”)

I wish to use the kayaks provided at The Farm House at Saluda River Farms, located at 73 Quinlan Drive, Greenville, SC 29617, during my stay.

By using the kayaks, I acknowledge and fully understand the following:

Acknowledgment of Risk

There is no supervision or lifeguard on duty. I am fully responsible for my own safety and the safety of all individuals using the kayaks during my stay.

Kayaking involves inherent risks, including but not limited to:

  • The risk of injury or death due to drowning
  • The risk of injury from capsizing, collisions, or loss of control
  • The risk of changing water conditions, currents, weather, or submerged obstacles
  • The risk of injury due to improper use of equipment
  • The risk of delayed emergency response due to location
  • The risk of injury while entering, exiting, or transporting the kayak

I understand that this is not a complete list of risks and voluntarily assume all risks associated with kayaking.

Agreement

  • Waiver of Claims
    I waive any and all claims that I have or may have in the future against the Releasees arising from my use of the kayaks.
  • Release of Liability
    I release the Releasees from any and all liability for injury, loss, damage, or expense, including those caused by negligence.
  • Indemnification
    I agree to hold harmless and indemnify the Releasees from any claims resulting from my use of the kayaks.

Responsibility & Compliance

  • I am over the age of 18
  • I will use the equipment responsibly
  • I will follow all safety guidelines
  • I will ensure minors are supervised at all times

Safety Acknowledgment

I understand the importance of wearing appropriate safety gear (including life jackets) and accept full responsibility for my decision to use or not use such equipment.

Binding Agreement

This agreement is binding upon me, my heirs, next of kin, executors, administrators, and assigns.

Acknowledgment

I have read and understood this agreement. I voluntarily agree to all terms and understand that I am waiving certain legal rights, including the right to sue.
